How to obtain a declaratory order from judicial magistrate ?

Hi, i need to change my passport DOB and Place of birth as per my Birth Certificate. As per the Consulate in USA require a Declaratory order from first class judicial magistrate to change the DOB and Place of Birth. Could you please let me know the process to get the declaratory order from first class judicial magistrate? How soon i can expect the Order? And what are all document required for this? Thanks,

Hai.
First f all a declaratory order comes from munsiff ( civil court). N for changing DOB in passport, earlier an affidavit from concerned magistrate with competant jurisdiction was all it needed.
Now laws have changed here now v have to move a civil suit for declaratory order b4 competant civil court having jurisdiction. The documents needed are all those papers where u have the same DOB(particularly a common date). Can conclude the whole things within 2 to 3 months.

Else if u still insist a paper from magistrate. I can get u one in a day but u have to come down personally n be present b4 the concerned magistrate.

Civil may cost 10,000
N magisrrate thing within 1000

The query lacks clarity. A declaration from the Court is possible if there are supporting facts. Naturally, the question what is the factual basis for seeking change of particulars duly entered in the Birth Certificate?

In India, the declaratory order for the purpose of change in the date of birth is issued by Civil court, not the Magistrate as in the case of attestation of an affidavit. For getting a declaratory order, a formal case has to be filed by making those authorities such as Passport office, State or other authorities who has to change the DOB in the concerned records based on such declaration as opposite parties. You may have to produce the birth certificate and other documents in which you wish to make the changes. If the authorities on the opposite side does not oppose the process, the court will issue the order without much delay. Still at least 3 months will take for that.
